Teacher Misconduct
TRA v HP, 2025 – defending the teacher against an accusation of unacceptable professional conduct in that he pushed a child from a classroom, which he accepted having done, succeeded in having the proceedings stopped as an abuse of process for the way in which the TRA had approached the evidence gathering stage, and what the teacher had been told as to the reason why the only independent witness was unavailable, which had not been accurate, and which unfairly prejudiced him so much that the Panel agreed with Damian's submission that a fair hearing was impossible. Accordingly, the proceedings were stayed without any evidence being called.
